Legislative amendments for preventing illegal covert surveillance

On April 28, “This Affects You Too” campaign member NGOs presented the package of legislative amendments, which aim at passing security sector reforms and improving covert surveillance system.

According to the proposed legislative package three new structures will be created and functions, powers and accountability of the existing structures will be changed.

The legislative package aims to newly define the functions of the State Security Service (SSS), to create a special agency, which will be the only body having the authority to conduct covert surveillance, to strengthen the parliamentary oversight of the security services, in particular, to establish a parliamentary supervisory board, who will have the right to observe and monitor the process of surveillance and activities of security services. Consequently, these agencies will be accountable to the Parliamentary Council and the Parliament.

Covert Surveillance should be carried out under the control of the court. Personal data protection inspector should have the right to stop the covert surveillance in case of violation of the terms and rules of eavesdropping. This will strengthen the supervisory function of the personal data protection inspector.

If the illegal surveillance still happens and law enforcement officers commit a crime, an independent investigative body will be involved in the investigation process.

We believe that the creation of an independent investigative body is the only solution that will end impunity and ensure an impartial investigation of police crimes.
